摘要
党的二十大报告提出要“以中国式现代化全面推进中华民族伟大复兴”。中国式现代化是个渐进过程,其中有许多重要侧面,新中国民法编纂是其中之一。民法史是新中国部门法史中的一个重要部分,反映了新中国科学立法、民主立法的历程,从一个微观的角度反映出新中国法治发展走过的道路。研究新中国民法典编纂中的一些重要问题,有利于通过这个重要侧面来观照新中国民法发展的规律,充分认识颁行民法典的重要性与必要性,从而自觉实施这一法典,切实保障民事主体的财产权与人身权,促进社会经济发展,为建设中国式现代化添砖加瓦。
The 20th National Congress of the Communist Party of China proposed the strategy to advance the great rejuvenation of the Chinese nation through taking a distinctive Chinese path to modernization.This approach to modernization is characterized by its gradual progression,encompassing numerous pivotal facets,and the formulation of the Civil Code stands as a prominent example.The Civil Code holds a substantial position within the legal history of the People's Republic of China,serving as a testament to the country's advancements in scientific and democratic legislation.Examined from a microscopic perspective,it offers a detailed narrative of China's legal development trajectory.Investigating the critical issues in the formulation of the Civil Code is invaluable for comprehending the intricate patterns of development within Chinese civil law.This comprehension underscores the gravity and necessity of enacting the Civil Code,facilitating its meticulous implementation.In turn,this ensures the safeguarding of individuals'property and personal rights,propelling socio-economic progress,and making a significant contribution to the realization of Chinese-style modernization.
