摘要
非集体成员继承农村房屋引发了非集体成员的继承权和集体成员的宅基地使用权之间的冲突,如何在继续保证集体成员的宅基地使用权的福利性质的基础上,不损害非集体成员的继承权,是化解非集体成员继承农村房屋所引发的权利冲突的关键所在。在新的时期,宅基地使用权制度的功能发生了较大的变化,宅基地使用权财产权属性凸显,其福利性质应得以一定程度的弱化,为非集体成员的继承权做出让步,允许非集体成员因继承农村房屋而成为宅基地使用权的主体。同时,应完善宅基地使用权的申请机制,建立宅基地使用权有偿和有期限使用相结合的机制,并有效防范宅基地的闲置。
The inheritance of rural houses by non-collective members leads to the conflict between the inheritance right of non-collective members and the right to use the homestead of collective members.How to ensure the welfare nature of the right to use the homestead of the collective members without damaging the inheritance right of the non-collective members is the key to resolve the conflict of rights caused by the inheritance of the rural houses by the non-collective members.In the new era,the function of homestead use right system has changed a lot.The property right attribute of the right to use the homestead is prominent,and its welfare nature should be weakened to a certain extent,making concessions for the inheritance right of non-collective members,allowing non-collective members to become the main body of homestead use right because of inheriting rural houses.While weakening the welfare nature of the right to use the homestead and strengthening the protection of inheritance rights of non-collective members,we should improve the application mechanism of the right to use the homestead,establish a mechanism combining paid and fixed-term use of the right to use the homestead,and effectively prevent the idleness of homestead.
