摘要
日常家事代理名为“代理”,但因其构成要件与法律效果,均有悖于代理的基本逻辑,故其代理性质一直饱受争议。与其直接探究日常家事代理是不是代理,不如将视角转向历史,追问日常家事代理为何被认为是代理。将日常家事代理解释为夫妻双方互为代理人的认识,可以上溯至《中华民国民法》。民国时期的立法者基于男女平等的理念,对清末继受自日本的以妻为夫之代理人的传统模式加以改造。新中国成立后,《婚姻法》自始对日常家事代理未予规定,但通过最高人民法院出台的司法解释,日常家事代理依托共同财产制,在实在法中获得新生。《民法典》第条为日常家事代理确立了全新的规则。借助历史分析所获得的启示,可以重思日常家事代理的规范属性、规范目的与体系关联。
Although Agency of Daily Household Matters is called“agency”,its constitutive elements and legal effects are contrary to the basic logic of agency,and its nature as an agency has been controversial.Rather than directly exploring whether Agency of Daily Household Matters is agency,we should turn our perspective to history and ask why Agency of Daily Household Matters is agency.The understanding of Agency of Daily Household Matters as the mutual agency of husband and wife can be traced back to the Civil Law of the Republic of China.Based on the concept of gender equality,the legislators of the Republic of China adapted the traditional model in which wife is the agent of husband,which was adopted from Japan in the late Qing Dynasty.Marriage Law of People's Republic of China,based on the socialist tradition,had not prescribed Agency of Daily Household Matters since the beginning.However,through the judicial interpretation of the Supreme Court,Agency of Daily Household Matters was finally reborn in the positive law under the community property system.Article 1060 of the Civil Code establishes a new rule for Agency of Daily Household Matters,and the insights gained from the historical analysis allow for a rethinking of the normative nature,normative intent and systemic relevance of Agency of Daily Household Matters.
