摘要
在行政犯时代下,针对刑事立法的活跃化、司法认定的形式化、刑法功能的工具化等问题,选择代表着谦抑性与人权保障的实质刑法立场,深入探讨行政刑法的一般理论具有重要意义。刑法与行政法之间的交叉与互动,衍生了行政犯这一特殊的犯罪类型。有“交叉”,有“互动”,就必须强调“协调”。就交叉关系而言,行政犯的双重违法性以及双重责任性是典型表征。前者应注意形式性行政要素与实质性行政要素各自的功能定位与效果发挥,后者应在区分成立阶段、制裁阶段以及执行阶段的基础之上作出科学把握。就互动关系而言,今后的行政犯应是在停止“犯罪化”的基础上稳步推进“除罪化”以及“非刑罚化”的过程。
In the era of administrative crime,in view of the activation of criminal legislation,the formalization of judicial identification and the instrumentalization of criminal law function,it is of great significance to choose the substantive criminal law position representing modesty and human rights protection,and to deeply discuss the general theory of administrative criminal law.The intersection and interaction between criminal law and administrative law has derived the special crime type of administrative crime.If there is“intersection”and“interaction”,we must emphasize“coordination”.In terms of cross relationship,the dual illegality and dual responsibility of administrative crime are typical characteristics.The former should pay attention to the functional orientation and effect of formal administrative elements and substantive administrative elements,while the latter should make a scientific grasp on the basis of distinguishing the establishment stage,sanctions stage and implementation stage.As far as the interactive relationship is concerned,the future administrative crime should steadily promote the process of“decriminalization”and“depenalization”on the basis of stopping“criminalization”.
