摘要
"电影作品和以类似电影方法表达的作品"是《保护文学和艺术作品伯尔尼公约》保护的重要作品类型,我国《著作权法》规定了"电影作品和以类似摄制电影的方法创作的作品",同时规定了"录像制品",适用"邻接权"保护,体育赛事、春晚等视听节目是"电影作品"还是"录像制品",争论不断、裁判不一,直接影响了视听产业的健康发展。随着社会的发展,"电影作品"的作品定义与分类,难以囊括不断出现的新作品类型。"视听作品"成为新的作品类型,能包含电影、电视、网络视频等有连续动态画面的,有伴音或者无伴音的视听类作品,甚至也包括画面连续动态效果并不典型的新型视听作品。《著作权法(修改草案)》首次增加了"视听作品"概念,并进行了定义,删除了"录像制品",但是后续的《著作权法(修改草案送审稿修改稿)》仅保留了"视听作品"概念,删除了其定义,且恢复了"录像制品"的规定。《著作权法》应该重新确立"视听作品"独立的法律地位,不再保留"录像制品"的分类。
"Cinematographic works and their assimilated works expressed by a process analogous to cinematography" is an important type of works protected by Berne Convention for the Protection of Literary and Artistic Works. The Copyright Law of the PRC stipulates that "cinematographic works and works created by a process analogous to cinematography" and "video recording" enjoy "neighboring right". While whether audiovisual works like sports events, Spring Festival Gala are "cinematographic works" or "video recording" has been argued constantly, directly affecting the development of audiovisual industry. With the development of society, the definition and classification of "cinematographic works" are failing to cover new types of works. The concept of "audiovisual works" was created and the audiovisual works refer to films, television programs, network video and other audiovisual works with a series of dynamic images, with or without accompanying sound, and even new audio works with non-typical continuous dynamic images. For the first time, the Copyright Law(Revision Draft) added the concept of "audiovisual works" and defined it, deleting "video recording". However, the subsequent Copyright Law(Revision Draft for Review) only retained the "audiovisual works", deleted its definition, and restored the provisions of "video recording". It is suggested to re-establish the independent legal status of "audiovisual works" and to no longer retain the classification of "video recording" in the Copyright Law.
