摘要
网络游戏规则是网络游戏的重要构成要素,是作者创作行为的产物,具体到一定程度的网络游戏规则已经脱离思想,蜕变成表达,在其具备原创性与可复制性的前提之下,应受著作权法保护。尽管网络游戏规则并不能归入现行著作权法中的特定作品类型,但这并不妨碍其获得应有的著作权法保护。对具体到一定程度的游戏规则赋予版权保护并不会导致思想垄断的后果,反而会有效遏制网络游戏发展中同质化的无序竞争,刺激游戏创新,推动产业发展。网络游戏规则实质性相似的判定可采取"抽象—过滤—对比"三步法;应区分网络游戏的基本规则和具体规则,网络游戏之间基本规则的相似并不会导致规则整体的实质性相似。
The rules of online games are an important component of online games and are the product of the author’s creative behavior.To a certain extent,the rules of online games have departed from ideas and transformed into expressions.Under the premise of being original and reproducible,they should be subject Copyright law protection.Although the rules of online games cannot be classified into the specific types of works in the current copyright law,this does not prevent them from obtaining the proper copyright law protection.Giving copyright protection to a certain degree of game rules will not lead to the consequences of ideological monopoly,but will effectively curb the homogeneous and disorderly competition in the development of online games,stimulate game innovation,and promote industrial development.The determination of the substantial similarity of online game rules can adopt the"abstract-filter-contrast"three-step method.The basic rules and specific rules of online games should be distinguished.The similarity of basic rules between online games does not lead to the substantial similarity of the overall rules.
