摘要
人工智能等高科技已经对法官思维产生诸多影响,积极的影响体现在:人工智能丰富了法官思维研究的内涵、有助于提升法官的逻辑思维、拓展了法官类比思维的技术运用。同时,人工智能也对法官思维带来一些消极影响,如带来了法官职业理性思维的减退、加深了法官思维的价值偏见、助长了法官的机械思维、遮蔽了法官思维的独立性。如欲缓解甚至克服人工智能给法官思维带来的诸种弊端,让人工智能等科技手段真正助力法官思维,促进法律统一适用,提升司法效能,今后应当加强人工智能与司法的技术融合、注重人工智能司法中法官的主体性作用、发挥法律方法在人工智能与法官思维结合中的作用。
Artificial intelligence and other high technologies have had many impacts on judges’thinking.Thepositive impacts reflects that artificial intelligence has enriched the connotation of judges’thinking studies,helped to improve judges’logical thinking,and expanded the technical use of analogical thinking for judges.At the same time,AI has also brought about some negative effects on judges’thinking,e.g.,bringing about adecline in judges’professional rational thinking,deepening the value bias of judges’thinking,promotingjudges’mechanical thinking,and obscuring the independence of judges’thinking.In order to alleviate oreven overcome the disadvantages brought by AI to judges’thinking,the future should strengthen the technicalintegration of AI and justice,focus on the subjective role of judges in AI justice,and play the role of legalmethods in the combination of AI and judges’thinking,which will be conductive to allowing AI and othertechnological means to truly assist judges’thinking,promote the uniform application of law and enhance judi-cial effectiveness.
