基础性网络服务提供者内容管理义务的反思与重构 被引量:7

摘要 当前互联网信息服务实践中,提供综合性技术服务的基础性网络服务提供者不断发展,形成“基础性网络服务提供者—信息服务提供者—用户”的三层内容服务结构。实践中,对基础性网络服务提供者在私法领域适用避风港规则、公法领域要求开展审查等内容管理的要求上,近乎与信息服务提供者相当,引发有关内容管理义务错配的思考。总的来看,对三层内容服务结构理解的偏差与技术耦合性扩大责任范围是当前错配的主要成因,从基础性网络服务提供者控制能力不足或成本高昂、间接获利的公平性、对平台私权力的限制以及遵守国际准则的角度分析,当前内容管理义务亟待重构。基于此,我国应考虑私法中的权利保护、公法中对内容生态的治理要求以及经济利益驱动以合理界定其内容管理义务,明确基础性网络服务提供者的主体范围,规定其独立地位并在内容管理中承担配合义务,对未履行资格核验和未提供配合义务的,要求承担相应责任,并对相关法律进行调整。 In the current practice of Internet information service,the basic network service provider,which provides comprehensive technical services,has been continuously developing and has formed a three-tier content service structure of“basic network service provider-information service provider(ISP)-user”.In practice,the content management requirements for basic ISPs,such as the application of the“safe harbor”rule in the private law area and censorship in the public law area,are almost comparable to those for information service providers,which leads to a reflection on the mismatch of content management obligations.In general,the misunderstanding of the three-tier content service structure and the expansion of the scope of responsibility due to technical coupling are the main causes of the current mismatch.Against this background,the existing content management obligations need to be restructured taking into account the insufficient control ability of the basic ISPs or the high costs incurred,the fairness of indirect profits,the limitation on platform power,and the observance of international norms.Accordingly,it is suggested that we should take into account the protection of rights in private law,the governance requirements of public law on content ecology,and the economic incentive when defining the content management obligations.We should also clarify the subject scope of basic ISPs,define their independent status and their obligation to cooperate in content management.And those who fail to fulfil the responsibility of qualification verification and cooperation,should be held responsible for their failure.Meanwhile,the government should also make adjustments to the relevant laws.
