摘要
以商事思维为主导的商事调解与我国现行调解制度的性质有本质差异。在签署《新加坡调解公约》的背景和我国正大力推广多元化纠纷解决机制的前提下,为确保商事调解的质量与合法性,同时发展我国的商事调解事业,应当将商事调解员的任职资格与人民调解员的任职资格区别开来。商事调解员的法定任职资格由商事纠纷的本质属性决定。我国需要从对专业知识与商事经验的掌握和调解培训两方面确立商事调解员的资格认证、管理和考核等制度,为规范化、制度化、专业化的商事调解员队伍设置法定门槛,使我国的商事调解与社会发展相协调,适应纠纷解决市场的多元需求。
Commercial mediation,which is dominated by commercial thinking,is fundamentally different in nature from the current mediation system in China.Against the backdrop of the signing of the Singapore Convention on Mediation and the fact that China is vigorously promoting a pluralistic dispute resolution mechanism,the qualifications for commercial mediators should be distinguished from those for people’s mediators in order to ensure the quality and legitimacy of commercial mediation while developing the cause of commercial mediation in China.The legal qualifications for commercial mediators are determined by the nature of commercial disputes.China needs to establish a system for the accreditation,management,and assessment of commercial mediators in terms of their professional knowledge and commercial experience and mediation training,so as to set a legal threshold for a standardized,institutionalized and professionalized team of commercial mediators,and to harmonize commercial mediation in China with social development and adapt to the diverse needs of the dispute resolution market.
