摘要
发挥数据要素作用,要区分数据的使用场景和用途用量,建立数据分类分级的授权运营制度。当前有不少地方已经开始探索公共数据授权运营的路径并展开试点,但具体到医疗领域,由于医疗数据主体多元、数据内容敏感复杂、医疗数据权属不明导致医疗数据的授权运营受阻。本文基于公共信托的视角,将政府视做医疗数据的受托者,承担对医疗数据持有、管理和保护的职责,赋予政府作为医疗数据持有者享有对医疗数据设立数据信托的权能。在数据信托中,数据信托机构将医疗数据授权给具有资质的数据企业,实现对医疗数据全面深入的开发,充分发挥医疗数据的价值。医疗数据在公共信托理论和数据信托技术的融合下,实现对医疗数据权属进行配置的同时,运用数据信托技术对医疗数据授权运营模式完成构建。To give full play to the role of data elements, it is necessary to distinguish the use scenarios and usage of data, and establish an authorization operation system for data classification and grading. At present, many places have begun to explore the path of authorized operation of public data and carry out pilot projects, but specifically in the medical field, the authorized operation of medical data is hindered due to the diversity of medical data subjects, sensitive and complex data content, and unclear ownership of medical data. Based on the perspective of public trust, this paper regards the government as the trustee of medical data and assumes the responsibility of holding, managing and protecting medical data, and gives the government the power to establish data trusts for medical data as a medical data holder. In the data trust, the data trust agency authorizes the medical data to qualified data companies to realize the comprehensive and in-depth development of medical data and give full play to the value of medical data. Under the integration of public trust theory and data trust technology, medical data can be configured to realize the ownership of medical data, and the data trust technology is used to complete the construction of the medical data authorization operation model.
