摘要
人格权请求权是一种独立的请求权。主要内容包括排除妨害请求权、停止妨害请求权和人身损害赔偿请求权。人格权请求权的主要功能是预防和保全。在人格权请求权与其他请求权的关系上 ,其与人格权侵权请求权属于聚合关系 ;与物权请求权、知识产权请求权属于竞合关系。
The claim of the personality right should be a type of independent claim. It mainly includes the claim for the removal of obstacles, the claim for the cessation of obstacles and the claim for the damages to bodily injury. Its principal functions are precaution and protection. As for the relations of the claim of the personality right and the claim of the other rights, it is clustering relation between the claim of the personality right and the tort claim of the personality right; and it is concurrent relation between the claim of the personality right and the claim of the real right and the intellectual property.
