摘要
公平竞争审查制度的实施有利于清理违反公平、开放、透明市场规则的政策文件,其对民营经济发展将发挥直接的促进作用。但目前的公平竞争审查制度存在一定程度的瑕疵,导致其在助推民营经济发展方面难以发挥全面作用。这主要体现在:审查标准中"竞争中立"政策的缺失;审查对象中对存量政策法规有效审查的缺位;审查实施中监督控制机制的弱化。未来应当致力于如下三个方面对公平竞争审查制度进行改进:将"竞争中立"政策纳入到公平竞争审查制度的基本理念与实施标准当中;建立回顾性审查机制,清理限制竞争的政策措施存量;重塑反垄断主管机构职权,明确其享有竞争评估和竞争倡导职能。
The implementation of the fair competition review system is conducive to clearing policy documents that violate fair, open and transparent market rules, and it will play a direct role in promoting the development of the private economy. However, the current fair competition review system has a certain degree of embarrassment, which makes it difficult to play a comprehensive role in promoting the development of the private economy. This is mainly reflected in the lack of 'competition-neutral' policies in the review standards;the lack of effective review of stock policies and regulations in the subject of review;and the weakening of the supervisory control mechanism in the review. In the future, we should make efforts to improve the fair competition review system by: including the 'competitive neutrality' policy into the basic concepts and implementation standards of the fair competition review system;establishing a retrospective review mechanism to clean up the policy measures that restrict competition;and reshaping the authority of the anti-monopoly authority and clarifying the competition assessment and competition advocacy function.
