摘要
公共数据授权运营不同于公共数据开放。从功能定位上来看,公共数据开放旨在为公众利用公共数据进行要素供给,公共数据授权运营则旨在为公众提供公共数据产品或服务。相较于公共数据开放,公共数据授权运营虽然有利于进一步释放公共数据的价值,但是,公共数据授权运营中同样也存在着数据超授权使用风险、数据泄露风险、个人信息权益侵害风险以及国家安全风险。公共数据授权运营中数据安全风险的体系化治理应以公共数据提供者、公共数据运营者以及公共数据监管者为核心,构建体系化的技术防范机制、风险评估机制、应急处置机制以及责任承担机制。
Authorized operation of public data is different from public data openness.From the perspective of functional positioning,public data opening aims to provide the public with public data for factor supply,and public data authorized operation aims to provide the public with public data products or services.Compared with the opening of public data,although the authorized operation of public data is conducive to further releasing the value of public data,there are also risks of data over-authorization,data leakage,personal information infringement and national security in the authorized operation of public data.The systematic governance of data security risks in the authorized operation of public data should take public data providers,public data operators and public data regulators as the core,and build a systematic technical prevention mechanism,risk assessment mechanism,emergency response mechanism and responsibility mechanism.
