摘要
制发社会治理检察建议,是检察机关参与社会治理最为重要的方式,也是新时代检察改革的重要抓手。检察机关参与社会治理源于三点因素:多元主体良性互动的治理转型、检察权的社会治理内涵以及检察建议制度的历史传承。由于适用边际界限模糊、制发机制规定不明和强制效力保障阙如等问题,限制了社会治理检察建议发挥作用的空间,制约了检察机关的法律监督职能。因此,必须有针对性地实现社会治理检察建议的体系完善。一是保持社会治理检察建议的谦抑性,通过坚持以维护公共利益为准则和推进检察建议的类型转化,厘清社会治理检察建议的适用边际;二是建立健全制发机制,制定线索发现分级分类处遇机制并合理限制制发对象,确保社会治理检察建议的规范完善;三是依靠监督主体、社会公众、建议对象的协同,实现多元治理的一体化建构,协同赋权社会治理检察建议。
Formulating and issuing procuratorial suggestions on social governance is the most important way for procuratorial organs to participate in social governance and an essential tool for procuratorial reform in the new era.The involvement of procuratorial organs in social governance stems from three factors:the transformation of governance through positive interactions among multiple stakeholders,the connotation of procuratorial power in social governance,and the historical inheritance of the procuratorial suggestion system.Howev-er,problems such as ambiguity in the boundaries of application scope,unclear regulations on the formulation and issuance mechanism,and lack of guarantee for mandatory effect,have restricted the space for procuratorial suggestions on social governance to play their role and hindered the legal supervision function of procuratorial organs.Therefore,it is necessary to improve the system of social governance procuratorial suggestions in a targeted manner.First,efforts should be made to maintain the restraint of social governance procuratorial suggestions by adhering to the principle of protecting public interests and promoting the typological transformation of procuratorial sug-gestions,clarifying their application boundaries.Second,it is essential to establish and refine issuance mechanisms,develop a tiered and categorized mechanism for handling leads,and reasonably limit the issuance targets to ensure the standardization and perfection of social governance procuratorial suggestions.Third,collaboration among supervisory bodies,the public,and the suggested subjects should be leveraged to achieve integrated construction of multi-stakeholder governance,empowering social governance procuratorial suggestions through collaborative efforts.
