Research on the People’s Procuratorate’s Investigation and Verification Power from the Perspective of the Rigidity of Legal Supervision

摘要转隶后检察机关法律监督面临刚性缺乏的问题。为此,需要进一步重视并运用《人民检察院组织法》赋予的调查核实权积极发现违法线索、有效印证违法行为。无论是从我国检察制度发展史还是立足域外比较,调查核实权都是检察机关的重要职权。调查核实权是法律监督的起点和后盾,能够查清违法事实,以严肃程序保证法律监督具有强制性,并体现法律监督积极主动的履职要求,是法律监督刚性的重要内核。当前,对于调查核实权还存在重视不够,职能发挥不充分,保障不力,效力不明等问题。为此,建议聚焦法律监督定位,进一步重视发挥调查核实权作用,运用大数据和检察一体优势,加强权力行使的技术保障和机制更新,通过立法完善,赋予人民检察院司法强制权,促进完善调查核实权成为检察机关法律监督刚性的支撑。 After the procuratorial organ’s anti-corruption and malfeasance department transferred,the procuratorial organs faced the problem of lack of rigidity in legal supervision.To this end,we need to pay more attention to and use the investigation and verification power granted by the Organic Law of the People's Procuratorate to actively discover illegal clues and effectively verify illegal acts.Whether from the perspective of the development history of China’s procuratorial system or from the perspective of extraterritorial comparison,the investigation and verification of real power is an important power of procuratorial organs.The investigation and verification of the power is the starting point and backing of legal supervision,which can find out the illegal facts,ensure the deterrence of the procuratorial organ’s legal supervision with serious procedures,and reflect the requirements of the legal supervision to actively perform its duties.It is an important core of the rigidity of the procuratorial organ’s legal supervision.At present,there are still problems such as insufficient attention to the power of investigation and verification,inadequate function,inadequate guarantee and unclear effectiveness.Therefore,it is suggested to focus on the legal supervision positioning,further pay attention to the role of investigation and verification,use the advantages of big data and procuratorial integration,strengthen the technical guarantee and mechanism update of the exercise of power,give the People’s Procuratorate judicial compulsory power through legislative improvement,and promote the improvement of investigation and verification to become the rigid support of the procuratorial organ’s legal supervision.
