摘要
2018年,欧盟《通用数据保护条例》在法律上确立了数据可携权这一概念。随后,我国《中华人民共和国个人信息保护法》首次规定了个人信息携带与转移权,但仅做原则性规定。出于健康医疗领域数据保护的急切需求和数据孤岛现状,建议我国设立个人健康医疗数据可携权,并在健康医疗领域进行数据可携权试点。通过深入剖析欧美、新加坡等国家和地区在数据可携权方面的立法经验和实践情况,结合我国实际,探讨设立个人健康医疗数据可携权的必要性与可行性。从权利创造的目的出发,研究其在设立过程中存在的困境和设立后可能引发的一系列衍生风险,结合权利结构,提出国外数据可携权概念在国内实践的具体措施。
In 2018,the EU General Data Protection Regulation established the concept of the right to data portability.Later,China promulgated the Personal Information Protection Law,which for the first time provides the right to carry and transfer personal information,although such a provision is suggested in the law to function as a general principle.Due to the urgent need for data protection in the healthcare field and the status quo of data silos,it is recommended that China establishes the right to portability of personal healthcare data and begins to pilot the right to data portability in the healthcare field.Through in-depth analysis of the legislative experience and practice of Europe,the United States of America,Singapore and other countries in the field of data portability,considering the actual situation in China,the author explored the necessity and feasibility of the establishment of the right to personal healthcare data portability.It studies the purpose of establishing the right in China,the potential dilemmas in the process of its establishment and a series of subsequent risks that may be triggered after its establishment,and proposes specific measures for the localisation of the currently foreign concept of data portability right in the light of the structure of the right.
