摘要
当前学术界关于自动驾驶汽车交通事故中民事侵权主体的理论探讨倾向于关注相关利益主体,而回避自动驾驶汽车本身的法律主体地位,这一做法的合理性存疑。鉴于高自动化及全自动驾驶汽车已具备高度自主性,赋予其法律主体地位不仅是社会发展的必然需求,也是保障人民权益的关键。因此,当高自动化及以上的自动驾驶汽车因自驾系统决策失误导致交通事故发生时,应将自动驾驶汽车自身视为主要侵权责任主体,而将人类主体(如使用者、生产商及销售商、远程安全员)作为辅助责任主体。在此基础上,构建以自动驾驶汽车为核心、人类主体为补充的递进式二级侵权责任承担机制。
At present,the theoretical discussion in the academic circle on the subject of civil tort in traffic accidents involving autonomous vehicle tends to focus on the relevant interest subjects while avoiding the legal subject status of autonomous vehicle itself.The rationality of this approach is questionable.In view of highly automated and fully autonomous driving vehicles having already achieved a high degree of autonomy,giving them the status of legal subject is not only an inevitable requirement of social development,but also the key to protecting people’s rights and interests.Therefore,when autonomous vehicle with high automation and above cause traffic accidents due to decision-making errors in the self-driving system,the autonomous vehicle itself should be regarded as the main subject of tort liability,while human subjects(such as users,manufacturers and sellers,and remote security officers)should be regarded as the auxiliary subject of liability.On this basis,this paper constructs a progressive two-level tort liability assumption mechanism with autonomous driving vehicle as the core and human subject as the supplement.
