摘要
人工智能在广泛应用的同时带来了事故型风险和技术风险,事故型风险主要存在于过失犯领域,对其进行防范应当强调研发者的注意义务。对人工智能研发者的注意义务予以认定时存在结果预见可能性的内容范围难以确定和结果回避义务的行为标准不明两方面困难。对此应当从注意义务的根据出发,在实质根据方面结合刑法目的并采用具体的法定符合说来限定研发者结果预见可能性的内容范围,在形式根据方面引入《产品质量法》中产品缺陷的相关规定作为结果回避义务的客观标准。
Artificial intelligence brings accident risk and technical risk when it is widely used. The risk of accident mainly exists in the field of negligence, and the duty of care of developers should be emphasized to prevent it. The content scope of result prediction possibility is difficult to determine and the behavior standard of result avoidance obligation is unclear when the duty of care of artificial intelligence developers judged according to the traditional negligent crime theory. To solve these problems, on the one hand, it is necessary to apply specific compliance according to the purpose of criminal law to limit the content scope of the developer’s result prediction possibility in terms of substantial basis. On the other hand, in terms of formal basis, relevant provisions of product defects in product quality law may be introduced as objective criteria for the obligation of avoidance of results.
