摘要
我国立法文本外译制度存在一定局限性,须及时进行制度创新,以适应新时代涉外法治工作战略要求。从新制度主义视角出发分析制度内涵,发现其具有规则、组织和文化三重属性。论证立法文本外译作为国家翻译实践的制度意义,分析当前困境及创新逻辑,基于此提出从规则、组织和文化三个层面开展政府主导的顶层制度设计,拓展中国立法文本外译制度创新思路。
There are certain limitations in the foreign translation system of China’s legislative texts,so it is necessary to proceed the institutional innovation without delay so as to adapt to the strategic requirements of foreign-related rule of law in the new era.Analyzing the institutional connotation from the perspective of new institutionalism enables us to find that it encompasses such trebling attributes as rules,organizations,and culture.This paper not merely argues for the institutional significance of foreign translation of China’s legislative texts as a national translation practice,but also analyzes the current difficulties and innovative logic,on the basis of which,a proposal is made to carry out the government-led top-level institutional design to expand the innovative thinking of foreign translation system of China’s legislative texts from the three levels of rules,organizations,and culture.
