论绿色元宇宙的法理构造 被引量:2

On the Legal Structure of the Green Metaverse

摘要 绿色元宇宙作为数字技术与环境技术深度融合的新兴形态,正成为实现“双碳”目标与推动数字生态文明建设的重要力量。以法理构造为分析视角,深入剖析绿色元宇宙的发展面临的法律挑战,并通过系统化的法律规制策略,构建对应的风险治理路径:一是明确各级政府、市场主体和社会公众在绿色元宇宙风险治理中的主体角色、权利义务和职权责任;二是构建碳排放监管、环境数据管理、绿色认证与激励机制等关键制度;三是明确虚拟主体环境责任、完善追责程序与生态修复机制,以及采取预防性法律措施。这些法治方式可以保障绿色元宇宙的可持续发展,明确绿色元宇宙主体、内容和责任三层法理构造,从而在技术创新与环境治理之间实现平衡,为绿色低碳发展提供治理新路径。 The green metaverse,as an emerging form of deep integration between digital and environmental technologies,becomes significant in achieving carbon peaking and carbon neutrality goals and promoting the development of digital ecological civilization.From the perspective of legal theory,legal challenges that the green metaverse faces are analysed in depth.And the corresponding risk governance path is constructed through the systematic regulatory strategy.First,to clarify the roles,rights,obligations,and responsibilities of various stakeholders,including government at all levels,market entities,and the public,in the governance of risks in the green metaverse;second,to establish key mechanisms such as carbon emission regulation,environmental data management,green certification,and incentive mechanisms;third,to define the environmental responsibilities of virtual entities,improve accountability procedures and ecological restoration mechanisms,and implement precautious legal measures.These legal frameworks ensure the sustainable development of the green metaverse by clarifying the three-tiered structure consisting of entities,content,and responsibility.This balance between technological innovation and environmental governance offers a new path for green and low-carbon development.
