摘要
AI孙燕姿等AI歌手本质上是对孙燕姿等特定表演者的模仿。对模仿行为的规制,理应属于知识产权法调整的范围。AI技术的发展严重影响了表演者、录制者和公众等民事主体之间的利益分配,法律理应对此做出应对。应对的直接表现是在维护基本的创作自由的前提下,赋予目标歌手控制AI模仿的权利,即在AI表演上设立“表演者权”。该权利的学理基础是防止AI表演对目标表演者表演的淡化,以维系录制者所需的产业秩序和新的商业模式。短期来看,可以扩大解释声音权等人格权来实现制度效果;长远来看,应当借鉴驰名商标的反淡化保护制度,以防止AI表演的模仿行为产生的淡化。
In essence,AI singers,such as AI Stefanie Sun,are copies of target artists'performance.Therefore,AI performance should be subject to intellectual property law.The development of AI technology has seriously affected the distribution of interests among civil subjects such as performers,recorders,and the public.The law should grant target singers the right to control AI performance while maintaining basic freedom of creation.It means that"performer's right"in AI performance should be established.The theoretical basis of"performer's right"is to prevent the AI performance's dilution to target performers.Only in this way,the industrial order and new business models required by the recording industry can be maintained.In the short term,the interpretation of personality rights,such as voice right,shall be expanded to achieve institutional effects.In the long run,the anti-dilution system of famous trademark shall be learnt to prevent the dilution of AI performance.
