摘要
绿色元宇宙本质在于可以全方位赋能碳中和。绿色元宇宙是一种能融合绿色经济和数字经济的社会新样态,其发展需要各国针对碳减排技术形成国际合作体制,其实现需要良法善治的规则之治。绿色元宇宙的法律治理需要国内法治与国际法治协同发展。在国内法方面,元宇宙所产生的碳排放涉及相关主体的责任承担,这些“数字人”的面纱是否应当被刺破以及被刺破后应遵循什么样的规则承担碳减排责任就成为关键性问题。元宇宙领域的碳减排技术体现的环境资源的经济价值,忽视了其非经济价值。在国际法方面,元宇宙发展的关键,在于其绿色化的全球化实现,要求各国运用绿色碳减排技术参与元宇宙。绿色元宇宙国内法治理关键路径在于建立元宇宙绿色能源追溯法律制度。为落实该制度,国家应通过立法促进元宇宙绿色发展,企业等私主体应该积极履行碳减排的责任和义务;此外,针对元宇宙交易中忽视环境资源非经济价值的问题,应该在相关立法中体现非资源环境权益。绿色元宇宙国际法治理的关键路径在于:应创设以国家公平价格强制转让与碳减排技术相关的义务和责任法律制度。
The essence of green metaverse lies in its ability to empower carbon neutrality in all respects.The development of green metaverse is a new social form that integrates green economy and digital economy.Its development requires international cooperation mechanism for carbon reduction technology,and its realization needs good laws and sound governance.The law-based governance of green metaverse requires the collaborative development of domestic rule of law and international rule of law.In respect of domestic rule of law,the responsibilities of the carbon emission from the metaverse should be borne by the corresponding parties,so it becomes a key issue whether the veil of these"digital man"should be pierced and what rules should be followed for assuming the responsibilities.The carbon reduction technology in the metaverse reflects the economic value of environmental resources,but its non-economic value may be neglected.In terms of international law,the key to the metaverse development is the global green initiative in which all the countries use green carbon reduction technology to participate in the metaverse.The key to the domestic rule of law for green metaverse is the establishment of traceable legal system for it.To implement this system,the state should promote green metaverse development through legislation,and other entities including the enterprises should actively perform their responsibilities and duties of carbon reduction.In addition,given the neglect of its non-economic value in metaverse transactions,the related legislations should reflect the non-resource environmental rights and interests.The key to the international rule of law for green metaverse is creating the legal system for mandatory transfer of obligations and responsibilities related to carbon reduction technology at a fair price to the states.
