摘要
在全球数字博弈背景下,中国加入《数字经济伙伴关系协定》(DEPA),符合中国当前内部完善治理需求和外部应对“规锁”挑战的需要。进一步研究如何处理好国内数据治理法规与DEPA对接的问题,并以此优化中国数据治理体系,将是未来理论与实践研究上的重点。DEPA在数据跨境流动规制方面采取了“原则+例外”的规制标准,其例外情形体现了比例原则之目的合法、手段合理和手段适度的内涵,确立了平衡“自由流动”与“安全发展”的基本模式。在中国与DEPA数据跨境流动规制对接上,中国数据本地化存储政策在适度性方面仍可能存在与之不相容的风险。中国应以DEPA标准为参照,以比例原则为指引,有序落实执法制度和配套机制以保障数据安全有序流动,优化数据本地化措施的适度性,驱动数据跨境流动体系良性运转。
In the context of the global digital competition,acceding to the Digital Economy Partnership Agreement(DEPA)is a means of improving digital governance and responding to external regulatory challenges.The research on constructing the connection between domestic data governance regulations and the DEPA and optimizing China's data governance system will be receiving theoretical and practical attention.While a regulatory standard of“principled free flow plus exceptional restriction”is embodied in the DEPA for cross-border data to strike a balance between“free flow”and“security protection”,it establishes the tests of legitimate purposes and reasonable and proper means for the invocation of the exceptions in line with connotation of the principle of proportionality.There is a risk of the incompatibility between the domestic regulation concerning data localization and the DEPA standard in terms of appropriateness.Therefore,it can be made on the basis of the principle of proportionality and the standard of DEPA as a guide,orderly implements data regulatory systems and measures and optimizes the measures of data localization in order to establish a well-functioning cross-border data flow system.
