摘要
可持续发展观是环境法典绿色低碳发展编的理论内核。从理论向度看,可持续发展观构建了环境利益公平分配格局,促导生产生活方式绿色变革,同时形塑了人际同构的绿色低碳发展秩序。环境普惠增益是环境法典绿色低碳发展编的规范意涵,不仅可以纠偏政策取代法律的错位型规范结构,而且能够提升资源环境综合利用功能的规范效果,以此重构符合生态阈值规律的规范价值。体系性科学逻辑是环境法典绿色低碳发展编的建构因应,明晰绿色生产、绿色流通、绿色消费和低碳经济促进、国际环境法治合作等各自章节特点以及与其他编章统辖融合的交互关系,并以此作为法理解读环境科学性的根基,有助于建构我国环境法典绿色低碳发展编“二元结构”的规范话语与系统思维。
The concept of sustainable development is the theoretical core of the green and low-carbon development of the Environmental Code.From a theoretical perspective,the concept of sustainable development has constructed a pattern of equitable distribution of environmental benefits,promoted green changes in production and lifestyle,and shaped a green low-carbon development order of interpersonal isomorphism.The benefit of environmental inclusion is the normative meaning of the Green Low Carbon Development Edition of the Environmental Code.It can not only rectify the misplaced normative structure of the policy to replace the law,but also improve the normative effect of the comprehensive utilization of resources and environment,so as to reconstruct the normative value in line with the ecological threshold law.Systematic scientific logic is the response to the construction of the green and low-carbon development section of the environmental code.It clarifies the characteristics of green production,green circulation,green consumption,low-carbon economy promotion,international environmental legal cooperation and other chapters,as well as the interaction with the integration of other chapters,and serves as the basis for legal interpretation of environmental science,which is conducive to the construction of the normative discourse and systematic thinking of the"meta structure"of the green and low-carbon development section of China's environmental code.
