摘要
在提出和采纳量刑建议应遵循的规则体系中,量刑建议有效规则是基础规则,其主旨为量刑建议适当是采纳量刑建议的法定实体标准;量刑建议效率规则是派生规则,其核心内容是量刑建议必须具有适当的弹性,应将量刑建议与最终量刑的差距限制在合法的范围内。量刑建议适当(不包括一般不当)是采纳标准;量刑建议基本适当是备选标准;量刑建议明显不当是调整标准。幅度刑量刑建议是达到备选标准的基本方式,是使司法建议权与司法裁定权恰当协调的最优方式,能够兼顾量刑建议权的约束力与量刑建议采纳权的权威性。立法上,不存在对审判机关具有法律约束力的一般应当采纳规则;司法中,规范文件也不认可具有司法约束力的一般应当采纳规则。量刑建议明显不当是采纳量刑建议的唯一法定除外情形;其他法律明定情形,排斥继续适用认罪认罚审理程序。
In the system when sentencing suggestion is proposed and adopted,the effective rule of sentencing proposal is the basic one,and its main idea is that appropriateness of sentencing proposal is the statutory entity standards for adopting,while the efficiency rule of sentencing proposal is the derived one,and its core content is that the sentencing proposal must have appropriate flexibility,so we can control the gap between the sentencing proposal and the declared sentencing within the legal scope.The appropriateness is the adoption of standards;the rough appropriateness of sentencing proposal is an alternative standard;the obvious inappropriateness of sentencing proposal is an adjustment of standards.The sentencing proposal with certain range is the basic way to reach the alternative standard,as well as the best way to make the right both of judicial proposal and the judicial verdict to coordinate properly,giving consideration to the binding force of the proposal right and the authority of the adoption right of the proposal.There is no general rule that should be adopted by the courts in the legislative field and the normative documents do not recognize rules that are legally binding and should generally be adopted in the judicial procedure.The obvious inappropriateness of sentencing proposal is the only statutory exception to the adoption of sentencing proposal.Other specific circumstances preclude the continued application of the admission of guilt and punishment procedure.
