中国专门学校教育制度的重构与推进——以未成年人专门立法修订为视角 被引量:6

The Restructuring and Improvement of Chinese Education Systema bout Special Schools amid Law Amendments

摘要 专门学校致力于去工读化改革,在新时期发展中陷入招生困境,入校就读的学生仍存在被标签化为“潜在问题孩子”的风险。而标签化具有双面性,除了具有将严重不良行为恶化为违法犯罪的负面效应,还具有使偏常行为的未成年人产生重整性羞耻感并改正其偏常行为的正面效应。长远看来,未成年人相关立法需进一步完善专门学校的相关制度,将分级干预的理念贯彻其中,根据不同的入学评估结果提供细致化的矫治方案,并从教育资源保障和社会评价改善等方面推进专门学校的发展,以发挥其教育矫治的正面效应。 Special schools,built for juvenile offenders in China,have been confronted with the difficulties of the enrollment of students in the new era,though greater efforts have been made in a reform to minimize the association of them with reformatories featuring a combination between academic studies and work.Students in special schools are often labeled as potential trouble-makers.The stigmatization of themcan be double-edged sword.Some minor delinquents are likely to commit crimes when they are mislabeled.On the other hand,some juvenile law-breakers will be ashamed of and take actions to rectify their previous behaviors.In the long term,the legislative departments should make an improvement of their laws and rules pertaining to minors and the operation of schools,and incorporate the concept of differentiated intervention into legislation.Involved students should be provided with precise plans of rectification in accordance with an assessment of them held at their entrance in special schools.Moreover,special schools should be accessible to sufficient supply of educational resource and the public are expected to make necessary adjustment of their opinions of such schools so as to make full use of their positive functions in educational rectification.
