我国校园欺凌行为的认定:标准之困与美国镜鉴 被引量:8

The identification of Bullying Behavior in Campus in China: Standard Difficulties and American Reference

摘要 当前影响我国校园欺凌防治的一个主要困境在于"校园欺凌"认定过程中的概念模糊。美国以直接欺凌和间接欺凌的行为作为认定标准,并进一步将主动攻击他人的意愿、持续性的攻击行为及双方实力的悬殊作为构成校园欺凌行为认定的基本特性,为我国提供了良好的借鉴。结合我国校园欺凌认定方面的现实困境,借鉴美国认定方式,应完善校园欺凌的认定标准,推动相关法律的惩治措施;明确校园欺凌的基本特性,细化欺凌的角色划分。发挥法律、学校、家庭等多方面的作用共同完善校园欺凌的认定,促进校园欺凌的防治。 The dilemma that affects the prevention and control of bullying in China is the vague concept in the identification of "school bullying". The United States regards direct bullying and indirect bullying as identification standards, and takes the willingness to attack others, persistent attacking behavior, and the disparity between the strengths of both parties as the basic characteristics of the identification of school bullying, which provides a good reference for our country. Combining with the dilemma in the identification of bullying in China and drawing on the American identification method, we should improve the identification standards for bullying and promote the punishment of relevant laws;clarify the basic characteristics of bullying and refine the role of bullying. Giving play to the roles of law, school, and family to improve the identification of bullying and promote the prevention and control of bullying.
