摘要
法律心理学作为一门学科产生于西方国家,在一百多年的发展中已逐渐成熟与完善。我国的法律心理学则兴起于20世纪80年代初,目前仍被界定为介于法学与心理学之间的一门边缘学科,其学科价值均未得到充分的挖掘。本文试从尚未形成法律心理学学科概念的中国古代法律思想和制度中,探寻法律心理学的源流及在其中的体现。
Legal Psychology as a subject was born in Western countries in the 19th century, which had been developed to maturity for more than one hundred years. In the early 1980s, Legal Psychology sprang up in China. It was treated as an interdisciplinary subject between jurisprudence and psychology, which value has not been explored. This paper tries to explore the sources of Legal Psychology in legal thoughts and legal system of the ancient China when the concept of the legal psychology had not formed.
