摘要
体育赛事转播权是一项新兴权利,关于该项权利的法律属性和权利归属在理论界尚未达成共识。二分法是在扬弃对体育赛事转播权法律性质单一定性的基础上发展起来的。二分法将体育赛事转播权分成直播意义上的体育赛事转播权和字面意义上的体育赛事转播权,避免了单一权利属性说者的逻辑谬误,但同时片面割裂了体育赛事转播权在流转过程中发生的属性转换。应当在动态和权利转换视角下正确认识体育赛事转播权的属性,有利于侵权责任的归责。
Sports broadcasting rights are new-emerging rights and have large differences in its legal nature and right definitions in academic field.Based on the reflecting on the simple definition of sports television broadcasting rights, the two-division method is developed recently. It means there are two kinds of sports television broadcasting rights： live transmission and re-transmission. However, the two-division method is too partial to ignore the change of nature of broadcasting rights in the process of rights trans- action.The nature of sports television broadcasting rights should be recognized in the right angle based on the viewpoint of rights change, in order to assume the tort liability.
