摘要
体育赛事GIF动图正在成为移动互联网时代传播体育赛事节目视频画面的重要手段。从形成过程分析,体育赛事GIF动图是一种复制体育赛事节目视频画面片段的新型技术。网络用户和网络平台经营者的使用行为存在较大差异,前者的使用可归入个人使用和合理使用的范畴,而后者的使用则侵犯了复制权与信息网络传播权。尽管体育赛事节目的定性存在着作品说与录像制品说的争议,但合理使用制度可适用于邻接权、录像制品制作者权之中,使得相应的定性争议对法律评价的结果不会产生实质性影响。通过利益平衡和交易成本的综合考量,扩展法定许可制度的适用范畴将有助于提升体育赛事GIF动图的传播效率,实现商业价值的最大化。
The GIF of sports events is becoming an important means of disseminating video images of sports events in the mobile Internet era.From the formation process analysis,the sports event GIF animation is a new technology to copy the video footage of sports events.The use of netizens and network platform operators are quite different.The use of the former can be classified into the category of personal use and reasonable use,while the use of the latter infringes the right of reproduction and the right of information network communication.Although the nature of sports events has the controversy between the works and the video products,the fair use system can be applied to the legislative reality of the right of neighboring rights and the rights of producers of video products,including the right of reproduction and the right of information network transmission,so that the corresponding qualitative disputes will not have a substantial impact on the results of legal evaluation.Through the comprehensive consideration of the balance of interests and transaction costs,expanding the scope of application of the statutory licensing system will help improve the communication efficiency of GIF of sports events and maximize the commercial value.
