摘要
研究行政执法证据在刑事诉讼中的使用,是完善行政执法与刑事司法衔接机制的的重要方面。我国《刑事诉讼法》第52条第2款规定的"可以作为证据使用"是指行政执法证据具有进入刑事诉讼领域的资格,无需刑事侦查机关再次履行取证手续。"等证据材料"的范围既包括实物证据,也包括言词证据,凡是不能在刑事诉讼中重新收集、调取的行政执法证据,都可以在刑事诉讼中作为证据使用。在刑事诉讼中,司法机关应从真实性、关联性和合法性三个方面对行政执法证据进行审查。
Studying the use of administrative law enforcement evidence in criminal litigation is to improve the convergence mechanism of administrative law enforcement and criminal justice. "Can be used as evidence" as prescribed in Paragraph 2, Article 52, Criminal Procedure Law refers to the use of administrative law enforcement evidence in criminal litigation without the evidence collection procedures of the criminal investigation organs. "The evidence materials" include physical evidence and verbal evidence. The administrative law enforcement evidence that cannot be collected and retrieved in the criminal lawsuit can be used as evidence in criminal proceedings. In the criminal proceedings, the judicial organs should review the administrative law enforcement evidence from three aspects, namely, authenticity, relevance and legitimacy of the evidence.
