摘要
法的基本价值就是人类或立法者对法追求的理想和目的。法律作为调整权利义务的规范,把落角点放在权利义务的调整上,必然会把利益的平衡作为法的基本价值。利益的平衡在我国立法、司法中早有体现,但利益平衡的价值贯彻还远远不够。文章从法利益价值的作用、体现和实现角度进行了研究,以期对我国的立法司法提供借鉴。
The basic values of law are ideals and goals pursued by mankind and legislators. Law ,as a rule of regulating rights and obligations, puts its view on the regulating of rights and obligations. It must take balance of interests as a basic value. The value of balance of interests has been embodied in our country's legislation and justice. But it is not enough. In this article we have done some research on the balance of interest's value. And we hope it will offer reference to legislation and jurisdiction.
