摘要
食品经营者与消费者之间的信息不对称是食品安全事件频发的主要原因之一。食品风险公告是有关行政部门向消费者发布信息提醒食品风险存在的行政事实行为。食品风险公告与食品风险警示相比,具有调整层次微观性、信息来源局部性及发布主体广泛性的特点。我国食品风险公告立法应进一步拓宽信息收集渠道,扩大发布信息的内容,明确发布主体权责以及建立统一的发布平台。错误的涉他性食品风险公告可能危及第三方经营者的合法权益,对于造成严重损害的食品安全风险公告,应当赋予第三方经营者提起救济的主体资格。
The information asymmetry between food operators and consumers is one of the main reasons for frequent food safety accidents; food risk announcement is one of administrative factual actions issued by the relevant administrative departments to remind consumers of existent food risk.Compared with food risk warning, food risk announcement has the characteristics such as the microcosmic study of adjustment, the locality of information source and universality of the issued subjects.Chinese food risk announcement legislation should further broaden the information collecting channel, expand the content of the issued information, clarify the responsibilities of the issued subjects, and establish a unified issue platform.As the wrong third-party-involved nature food risk announcement may endanger the third parties ' legal rights and interests, we should give the third party operators the subject qualification to lift relief for the food risk announcement that caused serious damages.
