摘要
大数据技术的运用,使得大数据"杀熟"行为呈现出区别于传统价格歧视行为的隐蔽性、灵活性、精准化等特征。深受其害的消费者呼吁对该行为进行管理规制,厘清大数据"杀熟"行为的违法性是对其进行引导规制的基础。
As price manipulation with big data exposed to public, the demands to control it speak more loudly. Some scholars have proposed that such behavior should not rely on legal regulation. It supposed to be the market, as an invisible hand, to regulate it, and consumers to make choices. The core of whether the behavior should be regulated lies in whether it is illegal that the operators use the personal data of consumers to charge different prices to different consumers and what laws and regulations are violated.
