摘要
算法歧视公益诉讼有望成为大数据时代公益诉讼制度在算法歧视治理层面的一种预设性尝试。当下算法权力打破了传统权力格局,公民利益因算法歧视受到侵害现象多发,算法歧视的隐蔽性更是导致了“行政万能论”的失效,因此,建构算法歧视公益诉讼制度极为必要。同时,建构算法歧视公益诉讼制度具备可行性。其中,公益诉权理论为其建构奠定了理论基础,现行法律法规为其建构奠定了制度基础,服务型政府建设为其建构奠定了主体基础,其他领域经验为其建构奠定了经验基础。算法歧视公益诉讼制度的具体建构,应从立法模式、受案范围、启动主体资格、诉前程序等方面予以进行。
Algorithmic discrimination public interest litigation is expected to become a pre-designed attempt at the level of algorithmic discrimination governance in the public interest litigation system in the era of big data.At present,algorithmic power has broken the traditional power structure.The interests of citizens are frequently violated due to algorithmic discrimination.The concealment of algorithmic discrimination has led to the failure of“administrative omnipotence”.Therefore,it is extremely necessary to construct an algorithmic discrimination public interest litigation system.At the same time,it is feasible to construct an algorithmic discriminatory public interest litigation system.Among them,the theory of public interest litigation rights has laid the theoretical foundation for its construction;the current laws and regulations have laid the institutional foundation for its construction;the service-oriented government construction has laid the main foundation for its construction;experience in other fields has laid the empirical foundation for its construction.As far as the specific construction of the algorithmic discrimination public interest litigation system is concerned,we should proceed from the legislative model,the scope of the case,the qualification of the initiating subject,and the pre-litigation procedure.
