摘要
系统论法学描绘出一个承担稳定规范性预期功能,运作封闭且认知开放,与社会共生演化的自创生法律系统,为观察和理解我国民事诉讼法律制度及其运行提供了新视角。在系统论视域下,我国民事诉讼法律系统呈现出“半自创生”特征,具体体现为规范性预期功能孱弱、运作封闭不足与认知开放弥散。与此同时,我国民事诉讼法律系统的复杂性化简能力不足,这可归因于重要的诉讼法法理未实证化、既有制度供给过于简化以及结构耦合机制相对缺乏。在迈向自创生民事诉讼的进程中,司法科技有望发挥“加速器”功效,以其规制与赋能的双重特征,增强我国民事诉讼法律系统运作的封闭性,拓展其认知开放的边界,强化稳定规范性预期功能,促使民事诉讼的内部结构转向更为复杂的“技术权审判权诉权”的金字塔型诉讼结构,从而有效增强系统的复杂性化简能力。
Jurisprudence of systems theory describes an autopoietic legal system that plays the role of maintaining stable normative expectations,operates in close and cognitively open form at the same time,and evolves symbiotically with social changes,thus providing a new perspective for observing and understanding China's civil procedure legal system and its operation.From the perspective of systems theory,Chinese civil procedure legal system presents a“semi-autopoietic”feature,which is embodied in its weak normative expectation function,insufficient operational closure and diffuse cognitive openness.At the same time,Chinese civil procedure legal system lacks the ability to simplify complexities,which can be attributed to the fact that important legal principles of procedural law have not been codified into positive laws,the existing supply of legal mechanisms is oversimplified,and the structural coupling mechanism is relatively lacking.In the process of moving towards an autopoietic civil procedure legal system,judicial technology is expected to play an“accelerator”role.With its dual characteristics of regulation and empowerment,it can strengthen the closure of operation of Chinese civil procedure legal system,expand its boundary of cognitive openness,and enhance the function of stable normative expectation,which prompts the internal structure of civil procedure to a more complex pyramid-shaped procedural structure of“technological power+adjudication power+litigation rights”,thereby effectively enhancing its ability to simplify complexities.
