摘要
法理类型的体系建构需要从法学研究的不同进路出发。法学研究有四种不同进路:描述性研究、规范性研究、教义性研究与分析性研究。通过考察发现,法学研究实践中存在四种不同的法理学:描述法理学、规范法理学、教义法理学与分析法理学。它们产生了四种不同类型的法理:作为法之规律的描述性法理、作为法之价值的规范性法理、作为法之原则的教义性法理与作为法之公约的分析性法理。在法学研究与法治实践中,这些法理起着重要的、不可相互替代的作用。
The systematic construction of the types of Fali should start from different approaches to legal study.Descriptive approach,normative approach,doctrinal approach,and analytical approach are the four approaches to legal study.There are also four different types of jurisprudence:descriptive jurisprudence,normative jurisprudence,doctrinal jurisprudence,and analytical jurisprudence.They generate four different types of Fali:descriptive Fali as regular patterns of legal phenomenon,normative Fali as the values of legal enterprise,doctrinal Fali as the general principles of law,and analytical Fali as the conventions of legal discussion.Different types of Fali play important and irreplaceable roles in legal study and legal practice.
