摘要
数据作为一项特殊的生产要素,需要在流通交易中释放价值。《数据安全法》和《中共中央、国务院关于构建数据基础制度更好发挥数据要素作用的意见》等为构建我国数据要素[1]流通[2]的基础制度提供了重要的法律和政策指引。而数据要素流通基础制度如何落地,需要立足数据要素流通实践问题和发展方向,寻求数据流通治理的有效路径。本文通过探究数据要素特性及数据流通的底层逻辑,分析数据要素流通交易和价值实现面临的主要问题,结合企业实践,从市场规律、政府监管、技术标准、法律制度等纬度提出数据要素流通治理模式的构建路径和需要关注解决的重点问题。
Data,as a special production factor,need to release value in flow and transactions.The“Data Security Law”,“Twenty Legal Articles on Data”and other legal policies provide important guidance for building the fundamental system of data flow in China.Data factor is economic terms.How to implement the fundamental system of data factor flow should be based on practical issues and the development direction of data factor flow,so as to seek an effective approach to data flow governance.This paper explores the characteristics of the data factor and the underlying logic of data flow,analyzes the principal questions of data transactions and value realization,combines with enterprise practice,and explores the approach of data factor governance model and key issues that need to be solved from the perspectives of market regulation,government supervision,technology and standards,legal rules,etc.
