论教育惩戒权的法律边界 被引量:48

摘要 教育惩戒权入法已在各界达成共识。但教育惩戒权作为一种公权力,当边界不清晰、缺乏有效的规制时,其行使就存在潜在的越界风险。因此,确立教育惩戒权的关键在于明确其法律边界。教育惩戒权的法律边界包括权力之间的内部边界和权力与权利之间的外部边界。有效防范教育惩戒权的越界,一方面,要明确规定教育惩戒权行使的主体、适用范围及适用条件,以使教育惩戒权区别于其他权力;另一方面,要明确惩戒的具体形式以及惩戒权行使的原则、程序,防范在教育惩戒权行使过程中对学生合法权利的侵犯;同时,还要建立教育惩戒权的监督、救济机制,以应对越界的教育惩戒权。 Legislation for education disciplinary power has reached a broad consensus. However,there is a high risk of breaking the legal boundaries when the boundary is not defined clearly and there are no effective restricts. This is also the most worrying issue when empowering schools and teachers with the disciplinary power. As a kind of public power,the boundary of education disciplinary power includes the internal boundary which refers to the relationship between different types of power,and the external boundary which refers to the relationship between power and right. On the one hand,in order to effectively prevent anyone from breaking the boundaries,the subjects,scope and conditions for using education disciplinary power should be clarified so that education disciplinary power can be distinct from other types of power. On the other hand,the forms of education disciplinary power,and the principles and procedures of using that power should be regulated clearly as well to protect students’ rights from being infringed. Furthermore,a supervision system for education disciplinary power is also needed in case of possible legal boundary breaking.
