摘要
建设中国式的法治现代化,首先要树立中国式的法治思维。中国式的法治思维与国际社会通行的法治思维有共性,主要表现为法理思维、国际法治思维和人权法治思维。法理思维是基础,国际法治思维是关键,人权法治思维是目的,贯穿其中的主线是尊重人权、约束公权、实现每一个人自由而全面的发展。中国式法治思维与国际社会通行的法治思维相比,也有独特性,如政党领导型法治、民主集中制、注重对权力的纵向监督、注重秩序优先和注重实质正义。中国式法治思维是共性和个性的有机统一,我们既要通过绝大多数国家都参加的国际公约寻找中国式法治思维的共性,也要善于根据国内外优秀法律文化进行创造性转化和创新性发展,构筑中国式法治思维的个性。
To build a Chinese-style modernization of the rule of law,we must first establish a Chinese-style rule of law way of thinking.Chinese-style rule of law thinking has similarities with the rule of law thinking popular in the international community,such as international rule of law and human rights protection thinking.China also has unique rule of law thinking rooted in China’s national conditions,such as party-led rule of law,democratic centralism,vertical supervision of power,and the emphasis on order priority and substantive justice.Chinese legal thinking is the organic unity of commonality and individuality.We must not only find commonalities in Chinese-style rule of law through international conventions to which the vast majority of countries participate,but also be good at creative transformation and innovative development based on excellent domestic and foreign legal culture to build the individuality of Chinese-style rule of law thinking.
