摘要
"左"的阶级斗争为纲的法制可以毁灭社会主义,右的全盘西化式的法制也可以葬送社会主义;计划经济绝对不能走向现代法治,休克疗法式的市场经济也不能带来现代法治;思想道德建设离不开法制保障,而法治的运行也离不开社会主义核心价值的支撑;现代法治既要保障穷人的基本利益,又要维护富人的合法利益和创造财富的积极性。中国依法治国主要有五大内容,其关键是实现体制内和体制外的良性互动、集中能力办大事和防错纠错能力的双重提高。秩序与渐进是中国依法治国的必由之路。法治是一种时代性和地方性知识。
Taking the class struggle of ＂leftist＂ as the key link can destroy the socialist legal system, the legal system of total westernization of rightist can also bury socialism . Planned economy can not toward a modern rule of law absolutely, the market economy of shock therapy can also not bring modem rule of law; Ideological and moral construction can not separated from legal protection, and also the operation of the rule of law can not be separated from the support of the core values of socialism. Modem rule of law not only protect the basic interests of the poor, but also safeguard the legitimate interests and the enthusiasm of the creation of wealth of the rich. There are five major aspects in governing the country according to law, the key is that achieve the benign interaction within the system and outside the system, and the abilitys raising double of doing big things carefully and anti - error detection and correction . Order and gradation is the only way to the rule of law in China. The rule of law is an era and local knowledge .
