摘要
40年改革开放的历程,也是我国法制体系建设和教育法律体系建设的历程。1980年学位条例的颁布,标志着我国教育法律体系建设的起航。经过40年的发展,教育法律已覆盖了我国教育基本领域,体系已基本形成,现在进入了全面完善中国特色社会主义教育法律制度体系的新阶段。为此,需要认真研究其特点、基本概念,构建教育立法为民的制度,将维护人民群众教育权力和社会急需的教育领域的法律尽快进入立法进程,才能保障社会主义教育事业的改革发展,形成完善的教育法律体系。
The course of Reform and Opening Up in the past 40 years is also the course of the construction of legal system and educational legal system in China.The promulgation of the Degree Regulation in 1980 marked the beginning of the construction of educational legal system in China.After forty years of development the legislation for education has covered the basic fields of education in China and the system has already formed Now it has entered a new stage of perfecting the legal system of socialist education with Chinese characteristics in an all-round way.Therefore,it is necessary to study its characteristics and basic concepts carefully and construc a system of education legislation for the people.Only when the laws in the field of education which can safeguard the people’s educational power and our society desperately needs is entering the legislative process as soon as possible,the reform and development of socialist education can be guaranteed and a perfect legal system o education can be formed.
