摘要
作为现代教育管理的两大命题,"依法治教"的概念形成于教育立法的恢复和繁荣阶段,因应了教育治理工具的转型,而"依法治校"的提法在进入新世纪后才逐步成型,旨在重塑学校治理结构,二者是主体不同的两个层次、重点不同的两个方面、不同阶段的两个重点。依法治教和依法治校的逻辑关联并不局限于宏观与微观之间的场域转换,它们在教育法治进程中相互依存:学校内嵌于整个教育系统中,依法治教为依法治校奠定了必要的基础,而学校身兼多重法律角色,由其生发的法律关系极为复杂,依法治校则成为依法治教的关键任务。更为重要的是,二者之间的互动耦合还形成了"软硬兼治""多元共治""学校自治"等新型教育管理模式,极大地拓宽了教育法治的内容和形式。
As two major propositions of modern education management,the concept of"Ruling education by law"was formed in the recovery and prosperity stage of educational legislation,reflecting the transformation of educational governance tools.However,the concept of"ruling school by law"has gradually taken shape in the new century,aiming at reshaping the governance structure of schools.They are two different levels of the main body,two different aspects of the focus and two key points in different periods.The logical connection between the two is not limited to the field transformation between macro and micro.They are interdependent in the process of ruling education by law,in view of the fact that the school is embedded in the whole educational system and"ruling education by law"provides the foundation for"ruling school by law".Of course,due to the multiple legal roles and complex legal relations of schools,"ruling school by law"has become the key way to show"ruling education by law".More importantly,the interaction between the two forms of new educational management modes,such as"hard and soft governance""multiple co-governance""autonomy in running schools"can enrich the content and form of the rule of law in education.
