摘要
随着大数据、人工智能等技术的快速发展和互联网应用的普及,个人信息在大规模收集与使用过程中面临日益严峻的安全风险。乳制品行业尤其是婴幼儿配方奶粉等领域,因涉及大量消费者个人信息(如身份、健康、消费习惯等),已成为信息泄露与滥用的高发领域,不仅侵害消费者隐私权,也可能引发刑事犯罪。刑法作为保障公民权益的最后防线,在个人信息保护中具有重要作用。本文以乳制品行业为研究对象,分析其个人信息处理中存在的刑法风险与监管缺失,并从技术、法律与企业自律三个层面提出完善路径,以强化该行业中个人信息的刑法保护机制。
With the rapid development of technologies such as big data and artificial intelligence,along with the widespread use of internet applications,personal information faces increasingly severe security risks during largescale collection and utilization.The dairy industry,especially in areas such as infant formula,involves a vast amount of consumer personal information(e.g.,identity,health status,consumption habits)and has become a high-risk field for information leakage and misuse.This not only infringes upon consumers’privacy rights but may also lead to criminal activities.As the last line of defense for safeguarding citizens’rights and interests,criminal law plays a crucial role in personal information protection.This paper took the dairy industry as the research object,analyzed the criminal law risks and regulatory gaps in its personal information processing,and proposed improvement paths from technical,legal,and corporate self-regulation perspectives to strengthen the criminal law protection mechanism for personal information in this industry.
