摘要
区域发展权作为第三代人权与空间生产力发展相结合的结果,是发展权在空间维度的拓展。当代中国提出的区域发展权的命题是我国区域经济发展不平衡、不充分的经济现象与国家实施区域协调发展战略综合驱动的结果。厘清并明确区域发展权的价值蕴含与权利要素,有助于为区域协调发展战略思路提供认识论基础。区域发展权内含自由、平等和正义的价值诉求和权利内容,以“空间正义”价值观为逻辑起点,区域利益的独立性和整体性是区域发展权利化的正当性基础。作为一种整体性存在,区域有自己特定的经济系统、社会功能和目标函数,需要在整体上谋求发展和实现效益,为此应以整体主义观看待“区域”的发展权主体地位问题。
As a result of the combination of third-generation human rights and the development of spatial productive forces,regional development right is an expansion of the right to development in the spatial dimension.The proposition of“regional development rights”at the present stage is the result of the combined drive of the economic phenomenon of unbalanced and inadequate regional economic development in our country and the implementation of the national strategy of coordinated regional development.Clarifying the value and elements of the right of regional development will help provide an epistemological basis for the strategic thinking on coordinated regional development,and is a necessary way to build a system of understanding of the rule of law and norms for coordinated regional development.The right of regional development implies the value and content of freedom,equality and justice,with the value of spatial justice as its logical starting point,and the independence and integration of regional interests as the legitimate basis for the rights-based approach to regional development.As a holistic existence,a region has its own specific economic system,social function and objective function,and needs to seek development and achieve benefits in a holistic manner,so the issue of the status of the region as the subject of the right to development should be viewed from a holistic perspective.
