摘要
情感计算应用于讯问有助于增强侦查人员现场感知能力,提升讯问的智能化水平,但该技术目前在讯问实战中存在侦查人员对其功效认识不清、情感表征方式选择不当、识别结果与讯问方法衔接不畅等问题。情感计算效用的发挥应以侦查人员深刻理解讯问对象拒供心理变化规律为前提、以构建符合国情的结构化讯问模型为基础,增强侦查人员讯问策略方法的系统性、普适性和可操作性,使情感解读具备讯问情境意义。情感计算的应用风险既同其他智能技术具有共通性又在讯问场景中具有特殊性,且技术应用初始阶段与成熟阶段的风险类型也有所不同。对此,可采取包容性治理策略,辩证理解技术应用的准确性与透明度问题,保障讯问对象知情同意权,并使以人为本的人机协同机制真正落实到情感计算理论研究、技术研发和实践应用的各个环节。
The application of affective computing in interrogation can enhance the investigators'ability to perceive affect and improve the intelligence level of interrogation.However,there are still some problems in the application of the technology,such as unclear understanding of its efficacy by investigators,inappropriate way of representing affect,and poor cohesion between recognition results and interrogation methods,etc.,which have resulted in the technology being confronted with practical obstacles of human-machine disconnection in interrogation.The exertion of the utility of affective computing should be based on investigators'deep understanding of the psychological changes of criminal suspects'refusal to confess,and on the basis of structured investigative interrogation model which meets the needs of Chinese interrogation practice,so as to enhance the systematization,universality and operability of investigators'interrogation strategies and methods,and make the results of affective computing have interrogative contextual significance.The application risks of affective computing are both common to other smart technologies and specific to interrogation scenarios,and the types of risks differ between the initial and mature stages of technology application.To this end,an inclusive governance strategy can be adopted,dialectically understanding the accuracy and transparency of technology application,ensuring the right to informed consent of criminal suspects,and truly implementing the human-oriented human-machine collaboration mechanism into all aspects of affective computing theory research,technology development,and practical application.
