摘要
自2021年新修订的《行政处罚法》明确“首违不罚”制度以来,各地公安交管部门颁布了大量“首违警告”清单。清单对贯彻人本主义、规范裁量、和谐秩序等方面发挥了重要作用。但是,通过检视各地清单,亦发现存在着背离“首违不罚”设计初衷、适用对象存在歧视性差别待遇、违法类型和时间范围各地差异较大、再犯问题处理思路不一的问题。为了更好地发挥“首违不罚”的制度效能,应当从统一构成要件、颁布省级清单、规范制度适用等方面入手,推动制度向科学化、规范化方向纵深发展。
Since the newly revised Administrative Punishment Law in 2021 clarified the “no penalty for the first violation” system,local traffic management law enforcement departments have issued a large number of warning lists for the first violation.The checklist has played an important role in implementing the values of humanism,normative discretion,and harmonious order.However,through a careful review of the local lists,it was also found that there were problems that deviated from the original intention of the “no penalty for the first violation” design,there are discriminatory and differential treatment applicable to the objects,large differences in the type and time range of violations from place to place,and different ideas for dealing with recidivism.In order to better play the effectiveness of the “first violation without punishment” system,efforts should be made to promote the in-depth development of the system in the direction of scientific and standardized system by unifying the constituent elements,promulgating a provincial-level list,and standardizing the application of the system.
