摘要
我国顺应数字时代的发展要求,运用了法律科技催生的在线诉讼这一现代诉讼新形态。在线诉讼与协同主义诉讼模式具有天然的契合性。在线诉讼借助现代信息网络技术的交互性优势适度淡化对抗,为协同主义诉讼模式的建构提供技术支持。但当前在线诉讼因缺乏诉讼促进义务、释明权能、集中审理主义三大协同要素的制度内核,导致其象征性功能大于内质性功能,甚至使技术本身的作用走向异化。未来中国式数字司法需全面引入协同主义诉讼模式,将数字技术嵌入诉讼程序的实际运行之中,实现诉讼规程的再造,倚靠法官发挥诉讼指挥权以及当事人协同配合,充分发挥电子诉讼的技术特色和程序优势,确保审判实践能够兼顾公正和效率的价值目标。
In line with the development requirements of the digital age,China has made use of on-line litigation,a new form of modern litigation spawned by legal technology.Online litigation is a natural fit with the collaborative litigation model.With the help of the interactive advantages of modern informa-tion network technology,online litigation moderately dilutes the litigation culture of confrontation and competition,and provides technical support for scientific and technological innovation for the construction of collaborative litigation mode.However,due to the lack of the institutional core of the three synergistic elements which includes litigation promotion obligation,interpretation power,and centralized trialism,the symbolic function of online litigation is greater than its intrinsic function,and even the role of tech-nology itself is alienated.Chinese-style digital justice needs to embed digital technology into the actual operation of the litigation procedure,so as to realize the reengineering of the litigation procedures of the collaborative litigation model in the digital era,and give full play to the technical characteristics and pro-cedural advantages of electronic litigation by actively relying on judges to give full play to the litigation command power and the coordination and cooperation of the parties,so as to ensure that the trial practice can take into account the value goals of fairness and efficiency.
