摘要
互联网平台在制定隐私政策的过程中刻意放大自身利益而弱化用户权益,在隐私政策的内容表述中使用含糊表达和双重标准,隐私政策“霸王条款”现象层出不穷。现有研究重点探讨了隐私政策的内容完整性特征和外部形式特征等,对隐私政策中的不公平性、模糊性和诱导性条款的关注不足。因此,本研究以国内具有一定知名度和代表性的19个互联网平台的隐私政策为例,基于扎根理论三级编码步骤,对隐私政策文本内容进行了初步的探索性分析,最终识别出了14个基本范畴、5个主范畴和1个核心范畴。研究结果表明,平台在隐私政策中利用自身的话语主导地位,在内容表述上采取了推诿责任、放大用户成本和一揽子授权等策略,其最终目的在于获取用户的推定同意和默认理解等。本研究提出扩展隐私政策制定主体、增强隐私政策交互性、完善动态同意机制等建议,旨在为规范隐私政策的制定过程和加强用户隐私保护等提供启发。
With the profit-driven nature of business organizations,Internet platforms tend to comply publicly with privacy protection laws but privately violate user rights using ambiguous and unequal terms in privacy policies.Previous research has explored the content characteristics and format design of privacy policies but failed to reveal malicious terms in these policies.To fill this gap,we selected 19 representative privacy policies from 19 Internet platforms.Fourteen categories(five main categories and one core category)were identified.Based on their predominant discourses,the results demonstrate that platforms adopt strategies such as shifting responsibility and excessively requesting personal information to obtain users’automatic acceptance.Considering the results,this study proposes several suggestions,including enhancing user engagement in policy design,designing more interactive user interfaces,and constructing mechanisms of dynamic acceptance,to provide implications for regulating the process of designing privacy policies and enhancing personal information protection.
