摘要
涉案企业合规整改在行政执法与刑事司法衔接上的难题主要表现为实体层面立法不完善、程序层面规则缺失、合规考察标准层面衔接混乱。主要原因在于刑事实体法上存在教义学困境、双重违法责任制与一事不再罚原则冲突、行刑衔接动力不足及监督机制有待完善等。鉴于此,在实体层面,建议修订法律,构建违法行为涉嫌犯罪的体系性判断路径;在程序层面及合规考察标准层面,进一步细化行刑衔接配合的规则与程序,包括构建行刑衔接清单管理机制、信息共享平台及监督机制,建立“刑行协同”一体化的合规整改机制,发挥行刑合规的双重优势,促进企业行刑合规结果的互认。
The difficulties of connecting administrative law enforcement and criminal justice are mainly manifested in three aspects:the imperfect legislation at the entity level,the lack of rules at the procedural level and the cohesion disorder at the level of compliance inspection standards.The causes of this dilemma include the doctrinal dilemma in the substantive law of criminal law,the conflict between the double liability system and the principle of no second punishment for one case as well as the lack of standardized norms for the convergence of execution and punishment.To solve the problem of execution linkage of enterprise compliance,it is recommended that,at the entity level,the law be amended to systematize the judgment of suspected criminal violations in terms of constituent elements.It is also necessary to further refine the rules and procedures for cohesion and cooperation in procedures and standards,including the construction of the management mechanism of the execution cohesion list and the information sharing platform,the establishment of the compliance rectification standard of the integration of"punishment and execution coordination",and the dual advantages of execution compliance to promote mutual recognition of the execution compliance results of enterprises.
